These Terms of Service ("Terms") constitute a legally binding agreement between you and LegacyBond AI LLC ("Company," "we," "us," or "our") governing your access to and use of the LegacyBond AI platform, including our website, mobile application, APIs, and all related services (collectively, the "Service"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By creating an account or accessing the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
If you are accessing the Service on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.
We do not knowingly collect personal information from individuals under the age of 18. If we become aware that a person under 18 has created an account, we will terminate that account and delete any associated data promptly.

Guest access (without account creation) is available for limited functionality. Guest sessions may have reduced memory retention and feature availability.

Recurring Billing. Monthly and annual plans are billed on a recurring basis through our payment processor, Stripe. Your subscription renews automatically at the end of each billing period unless cancelled. By subscribing, you authorize LegacyBond AI LLC to charge your payment method on a recurring basis.
Cancellation. Monthly and annual subscriptions may be cancelled at any time through your account settings (via the Stripe Customer Portal) or by contacting us at support@legacybond.ai. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the paid period. 5-year plans cannot be cancelled — they are one-time purchases.
Free Plan. A free tier is available with limited features. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
Price Changes. We may modify subscription prices at any time. We will provide at least 30 days' advance notice of any price changes. Continued use of the Service after a price change constitutes your acceptance of the new price. Price changes do not affect 5-year plans already purchased.
Failed Payments. If a recurring payment fails, we may suspend or terminate your access to paid features until the outstanding balance is resolved. We may retry failed payments and will notify you of payment issues.
Permitted Use. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

LegacyBond AI provides AI-powered companion characters for personal growth, reflection, and conversation. You acknowledge and agree that:
You are responsible for all content you share through the Service. Do not share information that you are legally prohibited from disclosing or that you would not want retained in our systems.
We may use conversation data in anonymized, aggregated form to improve our AI systems, subject to our Privacy Policy. We will never sell your individual conversation content to third parties.
Your privacy is important to us. Our collection, use, and handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. You should review the Privacy Policy carefully before using the Service.
You may request deletion of your account and associated data at any time by contacting us at support@legacybond.ai. Certain data may be retained as required by law or for legitimate business purposes as described in the Privacy Policy.
We implement commercially reasonable technical and organizational measures to protect your data. However, no system is completely secure, and we cannot guarantee the absolute security of your information.
Our Property. The Service and all content, features, and functionality — including but not limited to the software, text, graphics, logos, icons, images, AI models, and the selection and arrangement thereof — are owned by LegacyBond AI LLC or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Content. You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant LegacyBond AI LLC a worldwide, royalty-free, non-exclusive license to use, process, store, and display your User Content solely as necessary to provide and improve the Service.
Feedback. If you provide feedback, suggestions, or ideas regarding the Service, you grant us the right to use that feedback without restriction or compensation to you.
Trademarks. "LegacyBond AI" and related logos and marks are trademarks of LegacyBond AI LLC. You may not use our trademarks without our prior written permission.
The Service integrates with and relies on the following third-party providers to function:
Your use of the Service is subject to the terms and privacy policies of these third-party providers. We are not responsible for the practices of third parties, and we encourage you to review their policies. We do not sell your personal data to these providers; they receive only what is necessary to deliver their services.
We do not warrant that:
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
Our total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the amount you paid to LegacyBond AI LLC in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100.00).
The limitations of liability in this section apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.
You agree to defend, indemnify, and hold harmless LegacyBond AI LLC, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

By You. You may terminate your account at any time by contacting us at support@legacybond.ai or through your account settings. Termination of your account does not entitle you to any refund of prepaid fees.
By Us. We may suspend or terminate your account and access to the Service, with or without notice, if we reasonably believe that:
Effect of Termination. Upon termination, your right to use the Service ceases immediately. We may delete your account and associated data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
Governing Law. These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Binding Arbitration. Except for claims that qualify for small claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, or at another mutually agreed location.
Exceptions. Either party may seek emergency injunctive relief in a court of competent jurisdiction in Delaware to prevent irreparable harm pending arbitration. You may also bring individual claims in small claims court if your claims qualify.
Opt-Out. You may opt out of the arbitration agreement by sending written notice to support@legacybond.ai within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
Entire Agreement. These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and LegacyBond AI LLC regarding the Service and supersede all prior agreements, understandings, representations, and warranties.
Severability. If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of LegacyBond AI LLC.
Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, war, terrorism, labor disputes, government actions, or internet outages.
Language. These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall govern.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
To ensure a consistent, high-quality experience for all users, LegacyBond AI enforces per-plan usage allowances. Allowances are measured on a rolling 30-day basis starting from your subscription activation date or most recent renewal.
Monthly Allowances. The following limits apply per account per 30-day billing period:

Hourly Caps. To protect service quality for all users, the following short-term limits apply to every account regardless of plan:
If you reach an hourly cap, your access will resume automatically once the rolling window clears. Hourly caps do not consume your monthly allowance.
Top-Up Packs. Once your monthly allowance is exhausted, you may purchase one-time top-up credit packs to extend your usage:

Allowance Reset. Monthly message and voice allowances reset automatically every 30 days. Unused base-plan allowance does not carry over between periods. Top-up credits are unaffected by the reset and remain available until fully consumed.
One Active Session Per Account. Only one authenticated session is permitted per account at a time. Signing in on a new device or browser will invalidate your previous session. This is a security measure. LegacyBond AI is not liable for any interruption caused by a session conflict.
We reserve the right to adjust usage allowances, hourly caps, and top-up pricing at any time with reasonable advance notice as described in Section 14.
